About the Company
We are ‘KiDSnav’ a product provided by Kidsnav Limited (hereinafter referred as ‘website’, ‘we’ or ‘us’), having situated its registered office at Herefordshire, United Kingdom. We sale and market wrist-worn mobile phones for kids (aged between 2-12 years) in the name and style of ‘KiDSnav’ (hereinafter referred as the ‘device’) in United Kingdom as well as internationally. The Device is 2G enabled watch with features such as GPS tracking, voice calling, text messaging, pedometer, etc.
Contract for the Supply of Products and Services
The goods and services on the website is mere invitation and is not an offer to sell products or services at any price indicated on the website. The contract for the supply of goods or services will only and only deemed to exist between you and the website unless, and until, an email is sent by us to you confirming that your order has been accepted and payment has been successfully made.
We are free to reject any offer without quoting any reason and withdraw from a prospective contract at any time prior to delivery of goods. This also applies in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself.
KiDSnav is providing this site and its contents on an “as is” basis and makes no representations or warranties of any kind with respect to this site or its contents. We disclaim all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. In addition, we do not represent or warrant that the information accessible via this site is accurate, complete or current.
Order Processing, Dispatch and Delivery
Orders are processed only on clear payment confirmation from our bankers and payment gateway provider. Orders are dispatched on the same day or next working day as per the UK calendar. Dispatch of order may get delayed due to shortage of stock or any other unavoidable reason. In a case where the order is not dispatched within three days of placing of order, the customer may cancel the order anytime before despatch of the concerned order. For delivery of your orders we use only renowned logistics provider, which may take 3 to 5 working days to deliver your goods if your delivery address is in UK and 7 to 15 days if your delivery address is out of UK. However in any case, the delivery of goods is sole responsibility of logistic company and the delivery time may vary location to location.
Product Setup Guide
You are bound to adhere to our product setup guide in order to install and run the product successfully. The product setup guide is available elsewhere on the website and may also be supplied with your product package. Any deviation in application of product setup guide shall seize your right to claim refund or return or replacement under these terms.
Cancellation of Orders Prior to Delivery
Orders may be cancelled by email prior to the day of dispatch. The cost of the purchase will be refunded to the payment credit/debit card. As payment will have been processed by the credit/debit card services the refund will be made to reflect a cancellation fee of 5% of the initial purchase price. This is to cover our merchant services costs levied as a result of the purchase.
Return and Refund
Any customer wishing to cancel an order under the rights provided by the Distance Selling Regulations/Sale of Goods Act must do so by intimating the company via email within one month from the date of purchase. On receipt of your email we shall verify your claim and inform you about the authorisation or rejection of return request. You are thus requested not to refund any product with receipt of any authorisation from us. The authorised goods must be returned by Signed Delivery (Insured) to ‘Kidsnav Limited, Waterloo Road, Tonbridge, TN9 2SN, United Kingdom’. Customers are liable to pay the cost of this return postage. As long as the goods have been returned in original condition the cost of the goods will be refunded to the customer’s credit/debit card within 14 days of the date on which goods received by us. Any unauthorised goods returned to us shall be shipped back to you without any further liability of ours for return or replacement. No return and refund apart from what is mentioned in this clause will be entertained by us.
You understand that our product requires third party services, such as mobile application for GPS tracking and SIM card to communicate GPS with device. Both these third party services do not have any concern with us and performance of device may therefore vary depending on device battery, location, network, country, area, connectivity, mobile instrument & specifications.
The product comes with six months replacement warranty in case of lower performance of product battery, than what is mentioned on the product specifications. The product battery may lower performance in case heavy continuous usage of mobile network, frequent update of GPS location, pedometer usage, etc. Such lower performance shall be assumed to obvious and shall not amount to defect product battery. In case if the customer witness non-connection of product GPS within one week of delivery of product, the customer shall immediately contact to our customer support team and provide them a screenshot of such error. On confirmation of presence of such error by the customer support team, an authorisation for replacement will be made by us.
To dispatch replacement product, the original product must be returned by Signed Delivery (Insured). Customers are liable to pay the cost of this return postage. As long as the goods have been returned in original condition, a replacement product will be dispatched to the customer’s delivery address within 5 to 7 working days of the date on which a so called defective product received by us. We shall reimburse actual postage incurred by you for dispatch of so called defective product or £4.85, whichever is lower.
In any other case, whatsoever it may be, replacement of product will not be permissible.
When you use the website or send emails or other data, information or communication to KiDSnav, you agree and understand that you are communicating with us through electronic records and you consent to receive communications via electronic records from KiDSnav periodically, as and when required. We may communicate with you by email, SMS, telephone or by such other mode of communication, electronic or otherwise. Your use of the website entitles you to receive periodic communication regarding our goods and services through email, SMS, telephone or by such other mode of communication, electronic or otherwise. If you wish to not receive periodic informational communication from us you can unsubscribe to the communication through your account settings.
Advertisement and Promotions
Your usage of our website, implies to give permission to let “KiDSnav” use name of its company as customer of “KiDSnav” and as deemed fit may be covered under client list, testimonials, case study, video interview or mention on any other media without any fees/commercial payment. KiDSnav may run advertisements and promotions from third parties on the Services. Your business dealings or correspondence with, or participation in promotions of, advertisers other than KiDSnav, and any terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. KiDSnav is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of third-party advertisers on the Services.
Limitation of Liability (General)
Except as specifically stated on this site, neither KiDSnav nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including but not limited to compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. Partners and employees of this company may not be held liable for damages relating to either the capital cost of any equipment purchased from KiDSnav or consequential costs associated with fitting and operation of the same when issues arise from the non-availability of GSM and GPRS network coverage. It is the responsibility of the purchaser to take whatever steps necessary to establish that the necessary and appropriate network coverage is available and that the equipment works efficiently at the location intended for use. It is recommended that purchasers verify effective operation in countries outside the UK. KiDSnav does not guarantee that their tracking products will operate successfully in all parts of the world. Variations in GSM and GPRS network make this impossible, and accepts no liability for any loss in connection with failure of tracking service. Every effort will be made to assist in developing the required tracking but it remains the responsibility of the customer to ascertain if network coverage and tracking is possible in any particular global location.
To the maximum extent permitted by law, we shall not be in anyway liable to you and you hereby waive any indirect, economic, special, commercial, incidental, exemplary or consequential damages (including without limitation lost profits, loss of business revenue or earnings, lost data, damages caused by delays or a failure to realize exprected savings and the like) arising from or in connection with the use or performance of the battery, even if we are aware of the possibility of such damages.
Subject to local law, we disclaim and excludes all obligations duties or liability resulting from rim’s negligence. This limitation is intended to apply and does apply without regard to whether such damages are claimed, asserted or brought in an action or claim sounding in tort or contract, or under warranty, or under any other law or form of action. In no event we shall be liable to you or to any third party claiming through you or on your behalf exceed the purchase price of the product you purchased or the cost of replacing the product, whichever is greater.
International customer shall mean the customers whose delivery address is outside United Kingdom. We endeavour to serve our international customer in efficient manner, however we use the same infrastructure to serve international customer that we use for domestic customers. You as an international customer to adhere to your local laws and indemnify us against any non-compliance or liability caused by you or otherwise. You shall also responsible to pay off any customs or taxes or any other charges that required to paid while delivering the device to you by our logistics partners or their counterparts in your respective country. We also do not guarantee performance of our devices in your country as its generally works in UK.
You get a free access to the ‘KiDSnav’ Application for Android and iOS.
SIM card with a credit balance and 4G network is mandatory to operate the GPS device. We provide a free SIM card along with our product, which may be used by you for operating the device. For charges, terms and conditions, coverage, network, etc. related to SIM card you are requested to communicate with the SIM card company. SIM card supplied by us with the device is voluntary, thus you are free to opt for any other network provider for the GPS device operation.
Changes in Terms
We reserve the right to modify these terms at any time without giving any prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on our website.
Website Product Descriptions
We reserve the right to supply equipment which may differ in appearance from items shown on the website but which have the same use, function and facility.
The Service may not be used for any unlawful, fraudulent or abusive purpose and must be used as required by all applicable laws. In addition, the Service may not be used in conjunction with SIM cards or tracking devices which have not been supplied by us (other than mobile wireless devices). The Customer indemnifies KiDSnav in relation to any legal liability which may be incurred purely as a result of the Customer’s use of the Service.
